2004 California Legislation

This is an update on major bills through the end of the legislative session.  This has been a great session.  No bill that we opposed made it through the legislature.  Tenant sponsored bills that passed were negotiated to the point that our core interests were protected and we went neutral.

This is further proof of our ability to stop bad legislation.  We have done well articulating our point of view with moderate members of the legislature and we have a friend in the Governor’s office.

The Governor will now decide whether to veto the few bills that passed where we took a neutral position.  Since we already neutralized these bills to our satisfaction, Governor Schwarzennegger’s decisions will not adversely affect our interests.

ASSEMBLY BILLS

AB 1426 (Steinberg) - Affordable Housing: Greater Sacramento
This bill creates a pilot program to reward communities in Sacramento region that develop low-income housing.

AB 1850 (Cohn) - Property Taxation: Business Records Retention
This bill required maintenance of business records and created penalties for failure to comply.

  • Disposition:    Dead

AB 2088 (Dutra) - Residential Real Property: Costa Hawkins
This bill would have clarified right to increase rents to replacement roommates in rent control jurisdictions.

AB 2148 (Lowenthal) - Housing Elements
This bill
revises procedures for determining regional housing needs.

  • Disposition:    Passed awaiting action by Governor

AB 2175 (Canciamilla) - Conversion of Rental Housing
CAR sponsored bill to expand condo conversions.

  • Disposition:    Dead

AB 2194 (Cogdill) - Prevailing Rate of Per Diem Wages
CAA's prevailing wage bill.

  • Disposition:    Dead

AB 2348 (Mullin) - Housing Element: Regional Housing
This
bill makes numerous changes to the provisions of housing element law pertaining to land inventory, adequate sites, and permitted use, based on the work of the Housing Element Work Group and CHC.

  • Disposition:    Passed awaiting action by Governor

AB 2400 (Keene) - Controlled Substances: Meth Laboratories
This bill would have restricted rentals of apartments and placed liens on properties that had contained meth labs until abatement is completed.  Did not provide clear guidelines for abatement.

AB 2523 (Frommer) - Controlled Substances: Unlawful Detainer
This bill extends the authority of Los Angeles, Long Beach, Oakland and San Diego city attorneys to stand in the shoes of owners to evict drug dealers where owners decline to do so for fear of retaliation.

AB 2582 (Lieber) - Tenancy: Environmental Hazards
Major kill bill - would have allowed tenants to void contracts.

  • Disposition:    Dead

AB 2583 (Lieber) - Tenancy: Personal Information
Major kill bill - would have prevented collection of information on tenants.

  • Disposition:    Dead

AB 2980 (Salinas) - Housing Element: Self-Certification
This bill promoted inclusionary zoning.

SENATE BILLS

SB 17 (Escutia) - Property Taxation: Change in Ownership
This
end of session amendments bill would have created significant penalties for owners who failed to notify the state of change in ownership of property and would have eliminated penalty waiver provisions in existing law. 

  • Disposition:    Dead

SB 115 (Torlakson) - Landlord and Tenant: Payments
This bill
limits the ability to demand cash only payments except where tenants paid with invalid financial instrument. 

  • Disposition:    Passed awaiting action by Governor

SB 1145 (Burton) - Tenancy
Until January 1, 2006 , existing law requires a 60 –day notice for rent increases in excess of 10%. Until January 1, 2006 , existing law requires a 60- day notice of intent to terminate a tenancy if the tenant has resided in the building for less than one year. Until January 1, 2005 , existing law prohibits discrimination on the basis of a person’s source of income and the failure to account for the aggregate income of core residents. This bill would extend those provisions indefinitely.

SB 1404 (Soto) - Multifamily Improvement Districts
This bill establishes a pilot program for multifamily improvement districts.

SB 1508 (Ducheny) - Real Property Loans: Restrictions: Code Violations
This bill restricts loans on properties that have a notice of pending action for failure to correct serious code violations. 

  • Disposition:    Passed awaiting action by Governor.  Bankers are seeking a veto

SB 1609 (Dunn) - Housing Development Projects: Local Agencies
This bill would close loopholes in, and increases usefulness of Anti-NIMBY Laws. 

  • Disposition:    Dead

SB 1634 (Alarcon) - Real Property: Substandard Conditions
ACORN sponsored bill - would have created state Housing Inspector to monitor enforcement of state housing laws rules and regulations. 

  • Disposition:    Dead

SB 1722 (Ducheny) - Proposition 65: Enforcement: Judgments
CAA's bill on Proposition 65 lawsuits.
